The business-permit number and the contact details of the authority that issued it should be completed before publication where applicable under Luxembourg law.

2. Scope and acceptance

These Terms of Service govern access to and use of the Menukits website, merchant dashboard, digital-menu tools, QR/NFC-linked guest interfaces, menu-management functions, pickup/order-management functions and related SaaS services made available by Taptop Tech SARL (the “Service”). By creating an account, ordering a subscription or using the Service, the customer agrees to these Terms.

Where a written order form, commercial proposal or separately signed agreement conflicts with these Terms, the specifically negotiated written agreement prevails to the extent of the conflict.

3. Business customers and authority

The Service is designed primarily for professional users, including restaurants, hospitality businesses and authorised representatives acting in the course of business. A person accepting these Terms on behalf of an organisation confirms that they have authority to bind that organisation.

4. Menukits Service

  • creation and management of digital restaurant menus;
  • multilingual menu content and translation-assisted workflows;
  • display of dish descriptions, ingredients, allergens and dietary information;
  • QR-code and NFC access to guest-facing menu experiences;
  • optional pickup/order workflow and related restaurant-management functions;
  • other features, integrations or services introduced by Menukits from time to time.

Features may vary by subscription plan, geography, technical environment or product version. Menukits may reasonably improve, modify or discontinue individual features provided that it does not materially deprive a paying customer of the core contracted service without an appropriate remedy.

5. Accounts and security

Customers must provide accurate account information and keep credentials confidential. Customers are responsible for activity carried out through their authorised accounts and must promptly inform Menukits at hello@taptop.lu of suspected unauthorised access or security incidents affecting their account.

6. Subscription, pricing and payment

Current pricing, included features, billing frequency and any trial or annual-plan conditions are shown on the Menukits pricing page or in the applicable commercial proposal. Unless expressly stated otherwise, business prices are exclusive of VAT and other legally applicable taxes.

Subscriptions may be billed monthly or annually depending on the selected plan. Where automatic renewal applies, the subscription renews for the same billing period unless cancelled in accordance with the cancellation method communicated at checkout, in the account interface or in the commercial agreement.

Menukits may change standard list prices prospectively. Existing customers will receive reasonable advance notice of a price change that affects their next renewal, except where a change is required immediately by tax or law.

7. Trials, cancellation and termination

Any free-trial duration and conversion conditions will be stated when the trial is offered. A customer may cancel its subscription using the account-management method made available by Menukits or by contacting hello@taptop.lu. Unless otherwise agreed, cancellation takes effect at the end of the already-paid billing period and fees already accrued are non-refundable except where required by law or expressly agreed in writing.

Menukits may suspend or terminate access for material breach, unlawful use, security risk, non-payment after reasonable notice, or use that threatens the Service or third parties. Where reasonably possible, Menukits will give notice and an opportunity to remedy the breach.

8. Restaurant content and responsibility

The customer retains responsibility for the menu, product and business information it uploads, approves or publishes through Menukits. This includes prices, ingredient statements, availability, photographs, descriptions, allergen declarations, dietary labels and legally required food information.

The customer grants Taptop Tech SARL a non-exclusive licence to host, reproduce, transform as technically necessary, translate at the customer’s request, display and transmit customer content solely to operate and improve the Service.

9. Allergens, dietary information and food safety

Restaurants must review and validate allergen, ingredient and dietary information before publication and keep it current when recipes, suppliers or preparation methods change. Guests with allergies or medical dietary requirements should be directed to restaurant staff where confirmation is needed. Menukits does not warrant that customer-supplied food information is complete or error-free.

10. AI-assisted and machine-translated content

Menukits may offer AI-assisted translation, text generation, classification or quality-checking features. Outputs may contain errors or omissions and are provided as drafting assistance. The restaurant remains responsible for reviewing and approving AI-assisted content before publication, particularly allergens, ingredients, dietary claims, pricing and other safety- or compliance-sensitive information.

11. NFC and QR access

NFC and QR features provide convenient access to digital content but depend on compatible devices, browser settings, network availability and correct configuration. Menukits does not guarantee that every device will support NFC. QR access or another fallback may be provided where appropriate.

12. Intellectual property

Taptop Tech SARL and its licensors retain all rights in the Menukits software, branding, interfaces, documentation, databases, templates and other proprietary materials, excluding customer content. No licence is granted except the limited right to use the Service during the applicable subscription term.

13. Acceptable use

Customers must not use the Service to violate law or third-party rights, introduce malware, attempt unauthorised access, interfere with the Service, scrape or reverse engineer protected elements except where mandatory law permits, or upload content that is unlawful, deceptive or infringing.

14. Availability, maintenance and changes

Menukits aims to provide a reliable service but does not guarantee uninterrupted or error-free availability. Planned maintenance, security actions, internet outages, third-party failures and force-majeure events may temporarily affect access. Menukits may deploy updates and security patches without prior notice where necessary.

15. Third-party services

The Service may depend on third-party hosting, payment, communications, analytics, AI or integration providers. Third-party services may be governed by their own terms. Menukits remains responsible for its own legal obligations and will handle personal-data processors in accordance with applicable data-protection law.

16. Data protection

Personal data are handled in accordance with the Menukits Privacy & Cookie Policy. Where Taptop Tech SARL processes personal data on behalf of a restaurant customer, the Menukits Data Processing Agreement applies.

17. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded. Subject to mandatory law, Menukits is not responsible for indirect or consequential losses, loss of profit, loss caused by inaccurate customer content, or losses resulting from a customer’s failure to verify food, allergen or dietary information. Any contractual limitation of liability must be interpreted in light of applicable Luxembourg law and any individually negotiated agreement.

18. Notices and contact

Legal or contractual notices to Menukits may be sent to hello@taptop.lu and, where appropriate, to Taptop Tech SARL at its registered office. Customers must keep their own account contact details up to date.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Grand Duchy of Luxembourg, without prejudice to mandatory rules that apply under EU or national law. For B2B customers, the courts of Luxembourg shall have jurisdiction unless the parties validly agree otherwise.

20. Changes to these Terms

Menukits may update these Terms to reflect product, legal, security or operational changes. The current version will be published on menukits.eu with an updated date. Material changes affecting existing paid subscriptions will be communicated within a reasonable period where required.
